Welcome to the FlickArt Platform ("FlickArt," or the "Platform"), which includes the FlickArt official website, and any other current or future features, functionalities, or services (collectively, the "Services"). The Services are offered by FlickArt, Inc. ("we," "us," or "our"), with its registered office at 131 Continental Dr., Suite 305, Newark, New Castle County, Delaware 19713, USA.
We value your privacy and are committed to protecting your personal data. This Privacy Policy ("Policy") explains how we collect, use, share, and safeguard your personal information when you access or use the Services, including any site or platform that links to this Policy.

1.1 Information You Provide

If you register as a representative of an organization, we may also collect your name, business email address, phone number, country, physical address, and, if applicable, your organization's details.
(b) User Content. We collect content you create, upload, generate, or otherwise make available through the Services. This may include profile information (such as nickname and avatar), user-generated content, images, prompts, and any other material you create and/or share using the Services.
(c) Payment Information. When you purchase Paid Services (as defined in our Terms of Service), we use third-party payment processors to handle your payment transactions. These providers may collect your credit card details or other financial information. We do not store your full payment card details, but we may retain transaction confirmation or records required for compliance and accounting purposes.
(d) Correspondence Information. When you contact us for support, feedback, or inquiries—by email, chat, or other channels—we collect the information you provide, including message content and related details.
(e) Surveys and Promotions. With your consent, we may collect information when you participate in surveys, research studies, promotions, marketing campaigns, or events we organize or sponsor.
1.2 Information We Collect Automatically
When you interact with our Services, including when you browse without creating an account, we automatically collect certain information about your device and usage patterns. This may include:
(a) Technical and device information. IP address, browser type, user agent, mobile carrier, time zone, device identifiers (including identifiers used for advertising), device model, operating system, network type, and screen resolution.

With your permission, we may collect precise location for location-based functions.
(d) Cookies and similar technologies. We use cookies, mobile IDs, and similar technologies to operate and optimize the Services, enable features, and enhance your experience. You can manage or disable cookies through your browser or device settings.
1.3 Information From Other Sources
If you register for or access the Platform using a third-party account (such as Apple or Google), we may receive certain information from that third party, including your username, public profile details, and any other information you authorize them to share with us. We may also share limited information with the third-party provider to enable authentication and account linkage (e.g., app ID, access token, referring URL).
2. How We Use Your Information
We use your information to operate, provide, support, and administer the Platform and Services; enable their features; secure your account; and to fulfill, enforce, and comply with our Terms of Service. In particular, we use personal information to:
(a) Verify eligibility and age requirements;
(b) Provide, operate, and maintain the Services, including core functionality and account features;
(c) Fulfill requests for products, Services, functionality, support, and information; perform internal operations such as troubleshooting, data analysis, testing, research, statistics, surveys, and collecting feedback to improve the Services;
(d) Display, recommend, or otherwise promote your content to other users, consistent with your settings and Platform design;
(e) Communicate with you, including sending notices about changes to the Services, Terms, or policies;
(f) Provide customer support and respond to questions, requests, complaints, and feedback;
(g) Process transactions and support sales, promotions, purchases, subscriptions, refunds, and related support;
(h) Protect the Platform and our community by safeguarding security and defending our legal rights, property, commercial interests, and those of our affiliates, users, and the public;
(i) Enforce our terms, conditions, and policies and meet legal and regulatory obligations;
(j) Detect, investigate, and help prevent abuse, fraud, and illegal activity, including scanning, analyzing, and reviewing User Content and metadata for policy violations; and
(k) Use your information for additional purposes disclosed at collection, with your consent, or as otherwise permitted by law.
2.1 Legal Bases (GDPR and similar laws)
Where the GDPR or other data-protection laws apply, we process personal information under one or more lawful bases:
(a) Performance of a Contract. To enter into, perform, and administer our Terms of Service with you (e.g., create/manage your account; provide core Services and features; process payments or subscriptions; deliver requested content; respond to service inquiries).
(b) Consent. Where required by law or for optional features (e.g., marketing emails; surveys or beta programs; accessing certain device data such as precise location if enabled). You may withdraw consent at any time via settings or by contacting us; prior processing remains lawful.
(c) Legal Obligations. To comply with laws and regulatory requirements (e.g., tax and accounting; lawful requests from public authorities; identity verification or sanctions/AML checks where applicable; honoring data-subject rights).
(d) Legitimate Interests. To pursue our (or a third party's) legitimate interests, provided they are not overridden by your rights and freedoms—e.g., securing the Platform; preventing fraud/abuse; improving and developing the Services; measuring engagement; personalizing non-intrusive experiences; analytics and research.
(e) Protection of Vital Interests (Infrequent). In rare cases, to protect the vital interests of an individual (e.g., urgent safety issues).
(f) Establishment, Exercise, or Defense of Legal Claims. To assert or defend legal claims, manage disputes, or protect our rights, users, affiliates, or the public.
(g) Other Permissible Grounds. Where local law provides additional lawful bases, we may rely on them and will identify them at collection. We may aggregate or de-identify personal information for analysis, improvements, and research.
3. How We Share Your Information
We do not sell your personal information. We may share it with third parties for the purposes described in this Policy and as permitted by law, including:
3.1 Service Providers and Business Partners
Trusted third-party vendors and partners that help us operate, improve, and support the Services (e.g., payment processors; hosting and cloud providers; analytics/measurement providers; advertising and marketing partners where allowed by law and your preferences). These parties are bound by contractual obligations to process data only on our behalf and per this Policy.
3.2 Our Corporate Group
We may share information within our corporate group (subsidiaries, parent entities, and affiliates under common ownership or control) to operate/optimize Services, improve products/features, and conduct internal reporting and business planning. Where applicable and cross-border, we implement appropriate safeguards (see International Transfers).
3.3 Legal and Compliance Obligations
We may disclose information to law enforcement, regulators, courts, or other third parties when we believe in good faith that disclosure is necessary to: comply with law, processes, or lawful requests; enforce our Terms and other agreements; detect, prevent, or address fraud, security, or technical issues; protect the rights, property, or safety of our company, users, or the public; or establish, exercise, or defend legal claims.
3.4 Sale or Merger
Information may be shared or transferred in connection with corporate transactions (e.g., merger, acquisition, asset sale; financing, restructuring, or reorganization; bankruptcy, insolvency, or receivership). We will require the recipient to honor this Policy or provide equivalent protection.
3.5 With Your Consent
We may share your information with third parties for other purposes if you consent or direct us to do so. Where required by law, we will obtain explicit consent before sharing.
3.6 International Data Transfers
Personal information we collect may be stored and processed on servers located outside your country. We currently store data on secure servers in the United States, and we may engage affiliates/service providers in other countries to support operations. For cross-border transfers, we comply with applicable laws and implement appropriate safeguards. If you access the Services from the EEA, UK, or Switzerland and your personal information is transferred to a country without an adequacy decision, we implement safeguards such as the European Commission's Standard Contractual Clauses (and the UK Addendum or other approved tools), supplemented by technical and organizational measures.

You can view and update most of your profile information by signing into your account. Additional privacy controls are available in Settings. Depending on your location and applicable law, your rights may include:
(a) Access and Confirmation (to know whether we process your data and obtain a copy);
(b) Rectification (to correct inaccurate or incomplete data);
(c) Erasure ("Right to be Forgotten") (in certain circumstances, subject to legal/contractual obligations);
(d) Restriction of Processing (in specific situations);
(e) Data Portability (structured, commonly used, machine-readable copy and transfer to another controller, where technically feasible);
(f) Withdrawal of Consent (where processing is based on consent; withdrawal does not affect prior lawful processing);
(g) Opt-Out of Sales and Targeted Advertising (U.S. residents) under state privacy laws such as CCPA/CPRA;
(h) Objection to Processing (including for direct marketing); and
(i) Complaints to your local data protection authority.

5. Data Security
We take reasonable and appropriate technical and organizational measures to help protect personal data from unauthorized access, use, disclosure, alteration, and destruction. However, transmission of information via the Internet is not completely secure, and we cannot guarantee the security of information transmitted via the Services; any transmission is at your own risk. To help protect personal data, please use a strong password, never share it, and avoid reusing passwords across sites.
6. Data Retention
We generally retain information for as long as necessary to serve the purposes for which it was collected, including to provide the Services. We may retain information longer where required by law or where necessary for the establishment, exercise, or defense of legal claims. After you terminate use of the Services, we may store information in aggregated or anonymized form. We may also retain information as reasonably necessary to comply with legal obligations, resolve disputes, and enforce agreements.
7. Information Relating to Minors
The Services are not directed at children under the age of 13 (or equivalent minimum age in the relevant jurisdiction). If you believe we have personal data about or collected from a child under the relevant age, please contact us at founders@flick.art.

We may update this Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we make material changes, we will notify you within the Services or by other reasonable methods. The "Last Updated" date at the top indicates when changes take effect. Please review this Policy periodically. By continuing to access or use the Services after the effective date of an updated Policy, you agree to the revised terms. If you do not agree, you should discontinue using the Services.
